Premises
Failure to comply with this AUP will result in the immediate suspension or interruption of service (in accordance with the terms and conditions of supply relating thereto).
All requests for information regarding the content of this document should be addressed by opening a ticket on the https://42doit.com page.
Violations
- The use of the network and services 42doit is prohibited for the purposes of initiating and/or promoting illegal, abusive or irresponsible behaviour, including:
- Unauthorised access to or use of data, systems or networks, including any attempt to probe, examine or test the vulnerability of a system or network or breach security or authentication measures without the express permission of the owner of the system or network.
- The establishment or becoming part of activities that interfere with the use of the service to any user of the same, including, but not limited to, attacks by pirated software, cracks, keygenerators, serials, cyber attacks of any kind, including DOS attacks, viruses or other harmful components or deliberate attempts to overload a transmission system.
- Create situations of danger and/or instability and/or other problems of a technical nature as a result of programming activities and/or usage patterns that affect the quality of the user’s or other customers’ service, causing damage to the same, 42doit and/or third parties.
- Collecting or using email addresses, names or other identifiers without the consent of the person concerned (including but not limited to spamming, phishing, internet scams, password theft, spidering).
- The collection or use of information from third parties without the consent of the owner of the information.
- The use and/or dissemination of any false, misleading, misleading information, including but not limited to, by e-mail or newsgroup.
- Use of the service to distribute software that fraudulently collects information about users or illegally transmits user information.
- Use of the service for distribution of software c.d. “adware” unless: (1) you have explicit consent to download and install the software based on a clear and prominent notice about the nature of the software; (2) This is software that can be easily removed using standard tools for this purpose, including those in major operating systems (such as, but not limited to, Microsoft “add/remove”).
- The installation of networked applications that could create destabilization to the service or infrastructure.
- Offer harmful information (text or graphics) to the public.
- Use the Services 42doit to offer anonymous communication systems, without adequate maintenance of identities as required by applicable legislation, such as, but not limited to, c.d. “TOR” or “anonymizer”.
Use of system resources
You may not use the service in a way that interferes with the normal operation of 42doit’s services or make improper use of system resources, such as, but not limited to, The use of software that saturates the performance capacity of the network, disk system and CPU on shared platform (for example cloud, hosting, e-mail, etc.) for extended periods, if not for those services offered by 42doit in a dedicated form.
In such circumstances, 42doit may request to restore the normal level if such use is not in accordance with the use of other users, at its sole discretion.
The user agrees not to use equipment that is defective or not approved according to European standards, nor those that present malfunctions that may damage the integrity of the network and/or disturb services and/or create risks for the physical safety of persons. 42doit does not give any guarantee about the compatibility of the equipment and programs (hardware and software) used by the user with the service, being all the related verifications at the exclusive charge of the user.
The user shall also use the web space, possibly purchased from 42doit, exclusively for the publication of a website and not as a repository, that is to say as a tool for the mere storage of files, videos and/or own material and/or downloadable also from other sites.
Commercial e-mail addresses
- The dissemination of commercial messages is prohibited unless it can be demonstrated that:
- Recipients have given their prior consent to receive electronic mail via the express opt-in procedure;
- Consent-gathering procedures include appropriate means to ensure that the person giving consent is the holder of the e-mail address for which consent was given;
- The proof of consent of the recipient is kept in a form that can be readily produced upon request, with the burden on the recipient of 42doit’s requests to do so within 72 hours of receipt of the request;
- Procedures are in place to enable a recipient to withdraw consent, such as, but not limited to, a link in the body of the email or instructions to reply with the word “Remove” in the subject line, and be able to comply with the withdrawal of consent within 48 hours from receipt, informing recipients that the withdrawal of their consent will be processed in a maximum of 48 hours;
- An e-mail address for complaints is always displayed prominently on any website associated with the e-mail and messages sent to this address are found promptly.
- It is not allowed to obscure the sender of the email in any way.
The sender’s e-mail address must appear in the body of the message or in the ‘From’ line of the e-mail; these provisions apply to messages sent through the service, or for messages sent from any network by the user or by any person on his or her behalf that directly or indirectly refer to the recipient of a site hosted through the services. Furthermore, it will not be possible to use a ‘third party’ e-mail service that does not apply similar procedures to all its users. These requirements will apply equally to distribution lists created by third parties as if the list had been created by the user.
42doit reserves the right to verify and monitor compliance with the above provisions at any time, including by requesting information on a sample basis using the opt-in method.
42doit may suspend the transmission of e-mails that violate these provisions.
SMTP Authentication – Policy
In addition to the above provisions, no more than two hundred and fifty (250) recipients will be permitted to send e-mail messages of similar content through 42doit SMTP servers. Attempts to circumvent this restriction by creating multiple accounts or by any other means shall be construed as a violation of this restriction.
42doit reserves the right to suspend transmission of messages that violate these provisions. In addition, mail services may be suspended or interrupted if a violation of this AUP is found, in accordance with the general terms and conditions.
Mail Relay
In general, mass transmissions or transmissions of business information via e-mail are not permitted for a volume of more than 5,000 (five thousand) users per day with an average of 250 messages every 20 minutes. If you wish to send more than 5,000 messages per day, please contact our support team for further information.
Vulnerability tests
The user shall not in any way attempt to probe, examine, penetrate or test the vulnerability of the 42doit network system or breach the security of 42doit or its authentication procedures, either with passive or invasive techniques, without the express written consent of 42doit, nor, in the same way, may carry out such activities through the service provided by 42doit with respect to third party networks and/or information without their explicit consent.
Newsgroups, discussion forums, other networks
You acknowledge and agree that the content of commercial messages, messages on any electronic bulletin board, group chat or other forums in which you participate, such as, but not limited to, IRC and USENET groups, will be subject to compliance with the laws and regulations in force on the matter. Also, it must respect the rules of any other network (network or circuit) that you access or participate using the services 42doit.
Offensive content
- It is prohibited to publish, transmit or store on or through 42doit’s network and equipment any content or links to content that 42doit reasonably believes to be offensive:
- Constituting, depicting, promoting or referring in any way to paedophilia, racism, bigotry, or pornography content that is not included in compliance with the relevant regulations and accessible only to persons of legal age;
- Having obsessive, persecutory, stalking or bullying behaviour towards other users present on the site or outside the portal;
- Being excessively violent, inciting to violence, containing threats, harassment or hate speech
- Be unfair or deceptive in relation to consumer protection laws of any jurisdiction, including chain letters and pyramid schemes
- Be defamatory or violate people’s privacy;
- Create a risk to personal safety or health, a risk to public safety or public health, jeopardise national security or interfere with judicial investigations
- Improperly disclose trade secrets or other confidential or proprietary information of third parties;
- Have the purpose of helping third parties circumvent copyrights;
Infringe a third party’s copyright, trademark, patent or other proprietary right; - Referring (or presenting links) to gambling and/or online casinos, promoting illegal drugs, violating export control laws;
- Use the 42doit site for the purpose of and/or to facilitate illegal activities such as trafficking in human beings, trafficking in animals and/or protected species, trafficking in illegal and/or protected plants, trafficking in all living/non-living species and/or parts of them under protection to whatever degree they belong, trafficking in weapons, trafficking in precious objects, trafficking in artistic, historical, archaeological, religious objects or components;
- Use the 42doit website for the purpose of and/or to facilitate unlawful activities such as terrorism, mafia, usury, extortion, threat, blackmail, fraud, deception, theft, dealing, begging, money laundering, receiving stolen goods, bribery, prostitution, of whatever degree
- Be otherwise unlawful or solicit conduct that is unlawful under the laws applicable in the relevant jurisdiction, of the user or 42doit;
- Be otherwise harmful, fraudulent or likely to result in legal action being taken against 42doit.
- Content ‘posted or transmitted’ via the 42doit network or infrastructure includes web content, e-mail, chat and any other type of publication or transmission that is based on the Internet.
- Collect or store data and information from other users of the site unless expressly stated.
Copyrighted material
It is prohibited to use the 42doit network to download, publish, distribute, copy or use in any way any text, music, software, art, image or other work protected by copyright unless
- Has been expressly authorised by the right holder;
- Is otherwise permitted by applicable copyright law in the relevant jurisdiction.
Final provisions
The User undertakes to communicate to 42doit his/her personal data necessary for the complete and correct execution of the relationship; he/she also guarantees, under his/her own personal and exclusive responsibility, that the aforementioned data are correct, updated and truthful and that they allow for the identification of his/her true identity. The User undertakes to notify 42doit of any change in the data provided, promptly and in any case within and no later than 15 (fifteen) days from the occurrence of the aforesaid change, and also to provide at any time, upon request by 42doit, adequate proof of his/her identity, domicile or residence and, if applicable, of his/her capacity as legal representative of the requesting legal entity or holder of the Service.
Upon receipt of the aforementioned communication, 42doit may request additional documentation from the User to prove the communicated changes. In the event that the User fails to provide 42doit with the aforementioned communication or the requested documentation, or in the event that the User has provided 42doit with data that is false, not current or incomplete, or data that 42doit has reason, in its sole discretion, to believe to be such, 42doit reserves the right to
a) refuse the request forwarded by the User concerning operations to be performed in relation to the Service;
b) suspend the Services with immediate effect, without notice and indefinitely;
c) cancel and/or discontinue without notice any data modification operations associated with the Service;
d) terminate the relationship;
you agree that if the public IP addresses assigned to your account are placed on a black-list (abuse database) such as the one found on http://www.spamhaus.org, you will automatically be in violation of this AUP; consequently, 42doit may take all measures it deems appropriate to protect your IPs, including the suspension and/or termination of the service, regardless of whether the IPs have been reported/black-listed for a cause attributable to you
the user of the service accepts that data stored on a shared system may be quarantined or deleted if said data is infected by a virus or otherwise corrupted, and has, in 42doit’s sole discretion, the potential to infect or damage the system or data of other users that are placed on the same infrastructure.
The user undertakes to observe the rules of good use of network resources commonly referred to as ‘Netiquette’.
SLA
- No refunds provided by 42doit, when any, will be granted for service interruptions resulting from violations of this information document.
- Any document, photo, video, link, various information, account or publication in general posted within the 42doit website may be deleted, modified or suspended by the operator for technical or social reasons, or due to inappropriate user behaviour. Such unquestionable decisions made by 42doit will be enforced without any warning, authorisation or refund to the user of the site.
- 42doit reserves the right to notify the police and supervisory authorities of any unlawful conduct that is identified.
- 42doit does not have the ability to control the content published on its website. If the user finds any of the above-mentioned inappropriate content or content that he or she considers to be incorrect or inappropriate, he or she is requested to report this to the operator.
- 42doit has no control over the languages, idioms or jargons of the various geographical origins of the users.
- 42doit does not know: customs, habits, of any locality or world society reached by the service, so the form of control will be carried out according to the laws, statutes and morals of the Italian state.
- These information notes may be modified and supplemented over time without notice or communication from 42doit.
